1. Acceptance of Terms

By engaging HowfenStudio for website design, development, hosting, maintenance or related services, the client agrees to these Terms of Service.

Continued use of any website, hosting environment, domain configuration, email service or infrastructure managed by HowfenStudio constitutes acceptance of these terms.

2. Scope of Services

Services may include, but are not limited to website design and development, hosting and server management, domain and DNS management, email configuration, SEO optimisation, maintenance, backend systems and custom development.

All services are provided based on the agreed scope at onboarding. Anything not explicitly agreed in writing is outside scope and may be quoted separately.

3. Payment Terms

Monthly Plans

  • Payment is due on the invoice date.
  • Work may pause if payment becomes overdue.
  • Services may be suspended after 14 days overdue.
  • Services may be permanently removed after 30 days overdue.

Failure to pay may result in website suspension, hosting suspension, email suspension, removal of server access or deletion of website files and databases. A reinstatement fee may apply.

One-Off Projects

  • A deposit may be required before work begins.
  • The remaining balance must be paid before the website goes live.
  • No website will be deployed without full payment unless agreed in writing.

4. Hosting & Infrastructure Control

Any website, database, email service or digital asset hosted within infrastructure managed by HowfenStudio remains under operational control until all outstanding balances are cleared.

Clients may request migration to alternative hosting. Outstanding balances must be cleared prior to release of files. Migration fees may apply.

5. Ownership & Intellectual Property

Full ownership of the completed website design transfers once all balances have been paid in full.

Internal systems, backend logic, reusable modules, SEO controller structures and deployment frameworks remain the intellectual property of HowfenStudio unless agreed otherwise in writing.

6. Maintenance & Updates

Monthly maintenance includes minor updates and small adjustments. Full redesigns, structural changes, new feature development or complex integrations are outside scope and may be quoted separately.

7. Content Responsibility

Clients are responsible for supplying text, images, branding assets, legal policies and required third-party access. HowfenStudio is not responsible for delays caused by missing content or approvals.

8. Third-Party Services

Websites may integrate third-party services. HowfenStudio is not liable for downtime, pricing changes or policy changes imposed by third-party providers.

9. SEO & Performance

SEO improvements focus on technical structure and optimisation. Specific rankings, traffic levels or revenue increases are not guaranteed.

10. Backups & Data

Backups may be performed periodically. Clients are responsible for retaining copies of important data. HowfenStudio is not liable for data loss caused by third-party failures, cyber incidents or unpaid accounts.

11. Suspension & Termination

Services may be suspended where payments are overdue, terms are breached, illegal activity is identified or abuse occurs. Termination does not remove obligation to pay outstanding balances.

12. Limitation of Liability

HowfenStudio shall not be liable for loss of profits, revenue, business interruption or indirect damages. Total liability shall not exceed fees paid in the preceding three months.

13. Working Hours & Support

Support is provided during standard UK business hours. Urgent or out-of-hours requests may incur additional charges.

14. Refund Policy

Payments for completed work, hosting and development time are non-refundable. Monthly payments cover ongoing services and are not refundable once services have been provided.

15. Governing Law

These Terms of Service are governed by and interpreted in accordance with the laws of England and Wales.
